1. Inleiding en juridische grondslag

The Wings for Development, geregistreerd als Stichting onder het Burgerlijk Wetboek Boek 2 (Artikelen 285–304), stelt dit Beleid inzake Kinderbescherming en Veiligheid (AFG-beleid) vast als een bindend institutioneel kader.
Het beleid bevestigt de volledige toewijding van de Stichting aan het VN-Verdrag inzake de Rechten van het Kind (UNCRC), de EU-Gedragscode inzake Kinderbescherming, en aan de toepasselijke Nederlandse en internationale wetgeving ter bescherming van minderjarigen.

De Stichting erkent het inherente recht van elk kind op waardigheid, bescherming en participatie, en verbindt zich tot een veilige, respectvolle en inclusieve omgeving in al haar programma’s in Nederland en daarbuiten, inclusief in de Syrische Arabische Republiek.

2. Kernbeginselen
3. Waardigheid van het kind – Elk kind wordt met respect behandeld zonder enige vorm van discriminatie op grond van geslacht, religie, etniciteit, beperking of sociale status.
4. Het belang van het kind voorop – Het belang van het kind is de eerste overweging bij alle besluiten en activiteiten.
5. Recht op bescherming – Alle kinderen hebben recht op bescherming tegen misbruik, verwaarlozing, uitbuiting en elke vorm van lichamelijke, psychologische of seksuele schade.
6. Verantwoordelijkheid en transparantie – Al het personeel en de vrijwilligers zijn verantwoordelijk voor hun gedrag tegenover kinderen.
7. Nultolerantie – De organisatie hanteert een Zero Tolerance-beleid voor elk gedrag dat de veiligheid of het welzijn van een kind in gevaar brengt.

3. Toepassingsgebied en verantwoordelijkheden
4. Toepassingsgebied:
   Dit beleid is van toepassing op alle medewerkers, vrijwilligers, consultants, opdrachtnemers, partners en bezoekers die deelnemen aan activiteiten of programma’s van The Wings for Development.
5. Institutionele verantwoordelijkheid:

Voorzitter – Ahmad Jouaneh: Verantwoordelijk voor de algehele naleving van dit beleid en de afstemming op de Nederlandse wetgeving.

Contactpunt Kinderbescherming – Lara Khouri: Verantwoordelijk voor het ontvangen, documenteren en opvolgen van meldingen inzake kinderbescherming.

Alle medewerkers en vrijwilligers dienen dit beleid en de gedragscode te ondertekenen voordat zij hun taken opnemen.

4. Melding en reactieprocedure
5. Meldingsprocedure:

Meldingen van (vermoedelijk) kindermisbruik worden vertrouwelijk ingediend bij het Contactpunt Kinderbescherming (Lara Khouri) via de vastgestelde kanalen.

In ernstige of noodsituaties wordt de melding onmiddellijk doorgestuurd naar de Voorzitter (Ahmad Jouaneh) voor spoedeisende juridische stappen.

2. Onderzoeksproces:

Een interne onderzoekscommissie wordt ingesteld en voorgezeten door de Voorzitter of diens gemachtigde.

De identiteit van de melder blijft strikt vertrouwelijk.

Een schriftelijk onderzoeksverslag wordt binnen 14 dagen na ontvangst van de melding aan het bestuur voorgelegd.

3. Onmiddellijke beschermingsmaatregelen:

De organisatie kan tijdelijk een medewerker of vrijwilliger schorsen om de veiligheid van kinderen te waarborgen.

Er worden onmiddellijk maatregelen genomen ter bescherming van het betrokken kind.

5. Gedragscode

Deze Gedragscode maakt integraal en juridisch bindend deel uit van het AFG-beleid. Alle leden van de organisatie dienen de volgende regels na te leven:

1. Fysiek, verbaal of psychologisch geweld tegen kinderen is strikt verboden.
2. Foto’s, opnamen of persoonsgegevens van kinderen mogen niet worden gemaakt of gedeeld zonder schriftelijke toestemming van de organisatie en de wettelijke voogd.
3. Privé-contact met kinderen buiten officiële activiteiten, ook via sociale media, is verboden.
4. De privacy van kinderen moet te allen tijde worden gerespecteerd, ook tijdens educatieve of recreatieve activiteiten.
5. Ongepaste, dubbelzinnige of uitbuitende taal of gedrag is verboden.
6. Overtreding van deze code geldt als ernstig wangedrag en kan leiden tot beëindiging van het dienstverband of vrijwilligerswerk en melding aan bevoegde autoriteiten.
7. Al het personeel heeft de plicht om elke verdenking of gebeurtenis van kindermisbruik onmiddellijk te melden.

6. Uitvoering en toezicht
7. Het Bestuur herziet dit beleid jaarlijks om de naleving van Nederlandse en internationale wetgeving te waarborgen.
8. Alle nieuwe medewerkers en vrijwilligers ontvangen vóór aanvang van hun werkzaamheden een introductie- en trainingssessie over dit beleid.
9. Een goedgekeurde versie van dit beleid wordt openbaar gemaakt op de officiële website www.the-wings.org.

1. Introduction and Legal Basis

The Wings for Development, registered as a Stichting under the Dutch Civil Code (Book 2, Articles 285–304), adopts this Child Protection and Safeguarding Policy (AFG Policy) as a binding institutional framework.
This policy affirms the organization’s full commitment to the United Nations Convention on the Rights of the Child (UNCRC), the EU Code of Conduct on Child Protection, and relevant Dutch and international laws governing the protection of minors.

The Foundation recognizes every child’s inherent right to dignity, protection, and participation, and commits to providing a safe, respectful, and inclusive environment in all programs implemented both in the Netherlands and abroad, including in the Syrian Arab Republic.

2. Core Principles
3. Dignity of the Child – Every child shall be treated with respect and without discrimination on any grounds such as gender, religion, ethnicity, disability, or social status.
4. Best Interest of the Child – The child’s best interest shall be the primary consideration in all decisions and activities.
5. Right to Protection – All children have the right to be protected from abuse, neglect, exploitation, and any form of physical, psychological, or sexual harm.
6. Accountability and Transparency – All staff and volunteers are accountable for their conduct toward children.
7. Zero Tolerance – The organization enforces a Zero Tolerance Policy for any behavior endangering the safety, dignity, or well-being of a child.

3. Scope and Responsibilities
4. Scope of Application:
   This policy applies to all employees, volunteers, consultants, contractors, partners, and visitors engaged in activities or programs under The Wings for Development.
5. Institutional Responsibility:

President – Ahmad Jouaneh: Responsible for overall compliance with this policy and alignment with Dutch law.

Child Protection Focal Point – Lara Khouri: Responsible for receiving, documenting, and following up on child-protection reports.

All staff and volunteers must sign this policy and its Code of Conduct prior to assuming any official duty.

4. Reporting and Response Mechanisms
5. Reporting Procedure:

Reports of suspected or actual child abuse must be submitted confidentially to the Child Protection Focal Point (Lara Khouri) through the established reporting channels.

In serious or emergency situations, reports shall be immediately escalated to the President (Ahmad Jouaneh) for urgent legal action.

2. Investigation Process:

An internal Investigation Committee shall be convened and chaired by the President or a delegated member.

Whistleblower identity and all sensitive information shall remain strictly confidential.

A written investigation report shall be submitted to the Board of Directors within 14 days of receiving the complaint.

3. Immediate Protective Measures:

The organization may temporarily suspend any staff member or volunteer under investigation to protect children’s safety.

Immediate measures must be taken to ensure the child’s well-being and security.

5. Code of Conduct

This Code of Conduct forms an integral and legally binding component of the AFG Policy. All members of the organization are required to comply with the following rules:

1. Physical, verbal, or psychological violence against children is strictly prohibited.
2. No photographs, recordings, or personal data of children may be taken or shared without the organization’s authorization and the written consent of the child’s guardian.
3. Private or unsupervised communication with children outside official activities, including via social media, is prohibited.
4. Children’s privacy must be respected at all times, including during educational and recreational activities.
5. The use of inappropriate, suggestive, or exploitative language or behavior is forbidden.
6. Any violation of this Code constitutes serious misconduct and may result in termination of employment or volunteer status and notification of the competent authorities.
7. All personnel have a duty to report any suspicion, incident, or concern related to child abuse immediately.

6. Implementation and Monitoring
7. The Board of Directors shall review this Policy annually to ensure alignment with updates in Dutch and international law.
8. All new staff and volunteers shall receive orientation and training on the Policy before commencing duties.
9. A certified copy of this Policy shall be publicly available on the organization’s official website: www.the-wings.org.

أولاً: المقدمة والأساس القانوني

تُقر مؤسسة The Wings for Development، المسجلة رسميًا في مملكة هولندا بصفتها Stichting وفقًا لأحكام القانون المدني الهولندي (Burgerlijk Wetboek Boek 2, Artikelen 285–304)، هذه السياسة بوصفها إطارًا قانونيًا وإداريًا مُلزمًا لجميع العاملين والمتعاونين والمتطوعين في المؤسسة.

تعتمد هذه السياسة على اتفاقية الأمم المتحدة لحقوق الطفل (UNCRC)، ومدونة السلوك الأوروبية لحماية الطفل، وسائر القوانين والتشريعات الهولندية والدولية ذات الصلة بحماية القاصرين.

تؤكد المؤسسة التزامها الكامل باحترام كرامة الطفل وحقه في الحماية والمشاركة والنماء، وبتهيئة بيئة آمنة وشاملة لجميع الأطفال المشاركين في برامجها، سواء داخل مملكة هولندا أو خارجها، بما في ذلك الجمهورية العربية السورية.

ثانياً: المبادئ العامة

• كرامة الطفل: يُعامل كل طفل باحترام تام دون أي شكل من أشكال التمييز القائم على الجنس أو الدين أو العرق أو الإعاقة أو الوضع الاجتماعي أو الاقتصادي.
• مصلحة الطفل الفضلى: تُعد المصلحة الفضلى للطفل الاعتبار الأول في جميع القرارات والسياسات والإجراءات المتخذة.
• الحق في الحماية: لكل طفل الحق في الحماية من جميع أشكال العنف أو الإهمال أو الاستغلال أو الإساءة الجسدية أو النفسية أو الجنسية.
• المساءلة والشفافية: جميع الموظفين والمتطوعين مسؤولون قانونيًا وأخلاقيًا عن سلوكهم تجاه الأطفال، وتخضع أفعالهم للمراقبة والمحاسبة.
• سياسة عدم التسامح مطلقًا (Zero Tolerance): تعتمد المؤسسة نهجًا صارمًا بعدم التسامح مع أي سلوك يمس كرامة الطفل أو يهدد سلامته الجسدية أو النفسية أو الاجتماعية.

ثالثاً: نطاق التطبيق والمسؤوليات

1. نطاق التطبيق:
   تسري هذه السياسة على جميع موظفي المؤسسة، والمتطوعين، والمستشارين، والمتعاقدين، والشركاء، والزوار، المشاركين في أي نشاط أو مشروع تابع لـ The Wings for Development.
2. المسؤوليات القانونية والإدارية:

الرئيس – أحمد جوعانة (Ahmad Jouaneh): يتحمل المسؤولية العليا في ضمان الالتزام بهذه السياسة ومطابقتها للقانون الهولندي.

نقطة الاتصال الرسمية لحماية الطفل – لارا خوري (Lara Khouri): مسؤولة عن تلقي الشكاوى والتقارير المتعلقة بحماية الطفل، ومتابعة التحقيقات والإجراءات التنفيذية.

يجب على جميع الموظفين والمتطوعين التوقيع على هذه السياسة ومدونة السلوك قبل بدء أي عمل أو نشاط ضمن المؤسسة.

رابعاً: آليات الإبلاغ والاستجابة

1. الإبلاغ عن الانتهاكات:

تُقدَّم التقارير بسرية تامة إلى نقطة الاتصال الرسمية لحماية الطفل – لارا خوري عبر القنوات المحددة من قبل الإدارة.

في الحالات الخطيرة أو الطارئة، تُحال التقارير مباشرة إلى الرئيس – أحمد جوعانة لاتخاذ الإجراءات القانونية الفورية.

2. إجراءات التحقيق:

تُشكل لجنة تحقيق داخلية برئاسة الرئيس أو من يفوضه.

تُحافظ اللجنة على سرية هوية المبلّغ وكافة المعلومات المتعلقة بالحادث.

يُرفع تقرير مفصل إلى مجلس الإدارة خلال مدة لا تتجاوز 14 يومًا من تاريخ استلام البلاغ.

3. إجراءات الحماية العاجلة:

يحق للمؤسسة تعليق عمل أي موظف أو متطوع يُشتبه في تورطه إلى حين انتهاء التحقيق.

تتخذ التدابير الفورية لضمان سلامة الطفل وحمايته من أي أذى إضافي.

خامساً: مدونة السلوك (Code of Conduct)

تُعتبر هذه المدونة جزءًا لا يتجزأ من سياسة حماية الطفل (AFG Policy)، وتُطبَّق إلزاميًا على جميع موظفي ومتطوعي المؤسسة، وتُعد ملزمة قانونًا بموجب القانون الهولندي.

المواد الأساسية:

1. يُحظر تمامًا استخدام أي شكل من أشكال العنف الجسدي أو اللفظي أو النفسي تجاه الأطفال.
2. يُمنع التقاط الصور أو مقاطع الفيديو أو جمع البيانات الشخصية للأطفال دون الحصول على موافقة خطية من المؤسسة وولي الأمر.
3. يُحظر أي تواصل فردي أو خاص مع الأطفال خارج نطاق الأنشطة الرسمية، بما في ذلك عبر وسائل التواصل الاجتماعي.
4. يجب احترام خصوصية الأطفال في جميع الأوقات، بما في ذلك أثناء الأنشطة التعليمية أو الترفيهية.
5. يُمنع استخدام أي لغة أو سلوك يحمل إيحاءات غير لائقة أو يُمكن تفسيره كتحرّش أو استغلال.
6. يُعتبر أي خرق لهذه المدونة مخالفة جسيمة تستوجب إنهاء العلاقة التعاقدية فورًا، وقد تُحال للسلطات القانونية المختصة.
7. يلتزم جميع العاملين بالتبليغ الفوري عن أي حادثة أو اشتباه بانتهاك حقوق الطفل.

سادساً: التنفيذ والمتابعة

1. المراجعة الدورية:
   يُراجع مجلس الإدارة هذه السياسة سنويًا لضمان توافقها مع أحدث القوانين الهولندية والمعايير الدولية الخاصة بحماية الطفل.
2. التدريب والإرشاد:
   يخضع جميع الموظفين والمتطوعين الجدد لدورة تعريفية وتدريبية قبل المباشرة بالعمل تتناول مبادئ هذه السياسة ومدونة السلوك.
3. الشفافية والنشر:
   تُنشر نسخة معتمدة من هذه السياسة على الموقع الإلكتروني الرسمي للمؤسسة (www.the-wings.org) لضمان الشفافية العامة أمام الشركاء والمجتمع المحلي.
